TERMS OF USE

1. GENERAL

These Terms of Use should be read in conjunction with the Privacy Policy, as published on the online platform HelpRefugeesWork and apply to all persons using HelpRefugeesWork (from now on referred to as “Users”, and more specifically:

A. Persons accorded international protection in Cyprus, i.e. Refugee status or Subsidiary Protection (from now on referred to as “Candidates”)

B. Physical or legal persons registering on HelpRefugeesWork either as employers or training providers (from now on referred to as “Employers and Training Providers”). Training may include apprenticeships/internships, VET, upskilling offers on employability, personal development, leadership and community development, entrepreneurship and business, language training, tertiary education. The content of all published profiles, job vacancies and training announcements is handled by the competent Users.

The information published on the Platform does not constitute and should not be seen as authoritative legal advice in the individual case.

2. SERVICES

HelpRefugeesWork allows Employers and Training Providers to register on the platform, create and publish a company/organization profile and post job and training vacancies on the platform. The Candidates may also register and create a profile on HelpRefugeesWork in order to (i) apply in response to vacancies listed by employers on the platform (ii) be contacted notified by about Employers’ response in their application for a job vacancy in order to be informed about the result of their application for a job vacancy (iii) receive notifications about job and/or training postings of their choice.

Any employment and/or traineeship relation shall be agreed and concluded exclusively between Candidates and Employers/Training Providers. HelpRefugeesWork has no influence on the conditions, the content and the outcomes of employment and/or training relations.

3. FEES

Access and use of the platform is free of charge. No individual or organization is authorized to charge you any fees or solicit favors of any kind in order to help you to register with or use the platform.

4. USER’S REGISTRATION

Users must register in order to use the services of the platform. A valid email address and a mobile phone number is required. A welcome message with instructions on how the registration can be concluded is sent by the HelpRefugeesWork to Users.

Users must review and accept the Terms of Use as well as the Privacy Policy before registering and using the platform. Registration creates a legal relationship for an unlimited period, governed by the present Terms of Use.

A. EMPLOYERS

i) Data collected for creating a users’ profile and post job vacancies.

Once an employer confirms registration through email and after logging in the platform, they will be asked to confirm that:

• It has never been subjected to sanctions, legal penalties, or formal investigations involving labour exploitation, human rights violations, workplace discrimination, or Sexual Exploitation and Abuse, and that
• It guarantees that refugee employees will receive equal pay for equal work and equally safe working conditions.

Upon confirming both these declarations, the next step is to create a profile by entering the required information.

The template contains fields that are mandatory and others that are optional. After completing the employer's profile and before being able to post vacancies, the account of the company will undergo verification by the platform managers. The managers will inform the employer on the outcome of the verification process. If the account is verified, the employer will be able to post vacancies by filling information in a template that contains mandatory and non-mandatory fields.

Mandatory Info: This is the minimum information required from the user to fill-in, to register as an Employer and post a vacancy. It ensures that adequate information is conveyed to the interested parties and includes information typically found in job advertisements:

2.    Company Registration Number
3.    Contact Email of the organization
4.    Contact email of the person of reference
5.    Name of the person of reference
6.    Role of the person of reference
7.    Telephone of the person of reference:
8.    Indication of whether registering headquarters of the organization or a branch
9.    Title of vacant position:
10.    Occupation field/ position:
11.    Description of position:
12.    Location of the position
13.    Whether the posting concerns full-time/part-time job or an Internship/Apprenticeship opportunity
14.    If the position is permanent or not

Non-Mandatory information: This information can be submitted by the user, but is not mandatory for registering as an Employer and posting a vacancy. It includes information typically found in vacancy announcements:

1.    Logo/ Banner upload
2.    Address
3.    Website link
4.    LinkedIn link
5.    Facebook link
6.    Brief description of the Company
7.    Number of vacant positions
8.    Deadline date
9.    Required educational level of applicant
10.    Salary per month
11.    Salary information (n/a, Negotiable. fixed)

13.    Salary and information on whether the salary is fixed or negotiable
14.    Qualifications and skills of the applicant

B. TRAINING PROVIDERS

i) Data collected for creating a users’ profile and posting training vacancies.

Once a Training provider completes the registration, the next step is to create a profile, by entering the required information. The template has fields that are mandatory and others that are optional. After completing the training provider's profile, the account of the training provider will undergo verification by the platform managers. The managers will inform the training provider on the outcome of the verification process. If the account is verified, the training provider will be able to post training programs, by filling in information in a template, containing mandatory and non-mandatory fields.

Non-Mandatory information: This information can be submitted by the Training Provider, but is not mandatory for registering or posting a training vacancy. It contains information typically found in training vacancy announcements:

5.   TRUTHFUL INFORMATION

The User hereby guarantees to provide correct and true information on this platform, particularly regarding the information disclosed on his or her profile. HelpRefugeesWork is under no obligation to verify the information provided by the User, and is not liable or accountable for any illegal content or wrongful information on the platform.

6. BANNING USERS PROFILES

HelpRefugeesWork reserves the right to ban or block temporarily or permanently a User profile at any time, particularly in the following cases:

If the User has provided information that is deceitful, offensive or falls outside the scope of this platform
If there is suspicion or proof of misuse of the platform
If authentication of the information provided upon registration by the User is not possible
If the platform’s functionality is at risk of being damaged or compromised
In cases of serious violations of significant interests of the service provider
In other cases of serious violations of the present Terms of Use.

7. MAINTENANCE WORKS

HelpRefugeesWork does not guarantee that the User will be able to access the platform at all times. HelpRefugeesWork will endeavour to keep times for updates and other maintenance works as short as possible. HelpRefugeesWork is not to be held liable or accountable for any damages resulting from such maintenance works.

8. LIABILITY

HelpRefugeesWork is not to be held liable or accountable for saved information, copyright or trademark infringements of the Users. Further, the service provider is not to be held liable or accountable for any claims or damages resulting from the information the Users provide on the platform. HelpRefugeesWork is not to be held liable or accountable for any unlawful or unethical conduct of Employers or Training Providers towards the Candidate. HelpRefugeesWork is only connecting the Candidate with Employers and Training Providers via the platform and therefore only plays the role of an intermediary. However, the Candidate is encouraged to inform HelpRefugeesWork about any allegation of unlawful or unethical conduct on the part of the Employer or Training Provider as soon as possible.

9. CHANGES OF TERMS of USE

HelpRefugeesWork reserves the right to change the Terms of Use. HelpRefugeesWork will notify the Users in advance of upcoming changes.

10. SALVATORY CLAUSE

In the case that parts of this contract are unlawful, invalid or inexecutable, such parts shall not affect the legal validity of the remaining parts of the Terms of Use.

11. COOKIES POLICY
